Gay marriage is an issue that promises to rack the body politic in profound ways. It touches the very core of our American value system – family, (freedom of) religion, sex. And like slavery, which was legal in some states, not legal in others, gay marriage is a festering time bomb which needs to come to some sort of resolution, and hopefully one we can all accept. Out of 50 states, only a handful legally recognize gay marriage -- Connecticut, Vermont, New Jersey, Hawaii, Maine, Washington, New Hampshire, and of course, California, after Proposition 8, is now pending.
Judge Penny Brown Reynolds, the no-nonsense, racially ambiguous (until she opens her mouth, that is) and even wise adjudicator, who can be seen daily on 'Family Court,' allowed us some insight on the legal issues around gay marriage, how it affects the family and how the issue of gay marriage should be framed, especially in the black community. An ordained Baptist minister as well as judge, Judge Penny's answers may surprise you.

What is the state of gay marriage in legal terms today?
Well, this issue is decided state by state. Most gay couples will go and get legal documents whereby they can have a union for legal purposes only but it's not recognized by the state as a marriage. Generally they do it for the liquidation of property or for medical reasons. If you are hospitalized, generally hospitals will only allow close relatives to visit or make decisions; without those documents [partners] have no legal rights. In the state of California we all are very much aware that there was a deal that was recently enacted that made marriages between gay couples illegal and therefore nullifying the opportunity for people to be able to marry.
So for those people who married previously, does that nullify their marriage?
No it will not. It simply means that after the bill was enacted, all future marriages would obviously be illegal and they will not be recognized by the state.
Do you think at some point there is going to have to be a federal mandate around gay marriages? If so, when will this happen?
Let me tell you what I see happening with this issue form both a legal standpoint and also a moral standpoint as an ordained Baptist Preacher who is African-American. Overwhelmingly, statistics show that African-Americans do not support gay marriages. It is appalling to me in many respects that the African-American community could stand and protest anyone being oppressed -- and this is what the real issue is. It's not an issue of being right or wrong or whether or not you believe the Bible or if God sanctioned unions between same sex; it's an issue of oppression as I see it, both legally and morally. Whenever you take a right away from someone, you are oppressing them. We were told we couldn't marry outside of our race, who gets to be the arbitrary of what we can and cannot do? We have to decide to stay out of it.

Do you think you'll see legislation legalizing gay marriage in your lifetime?
I'll have to be honest with you, at the age of 47 I didn't believe that in my lifetime that we would have an African-American president, so I'm very hesitant to say that I don't know if in my lifetime we will ever have federal legislation legalizing gay marriages. It's all a matter of who would be brave enough in Congress to draft it. The current court that we have now I don't believe would sanction it. We have a very conservative Supreme Court. I don't think it will come out of this current Supreme Court. If it's purely a legal issue than certainly the legal conclusion comes to the point that people should be able to be married if they're the same sex. But it's more complicated than that. It's really a public policy issue so it's quasi legal and quasi public policy.
What kind of issues does gay marriage present for families and black families in your court?
Gay couples are really no different than heterosexual couples, they have the same issues like everyone else. What complicates things is when there is no legal entity involved in terms of marriage; therefore you cannot have a divorce. And so when you have children who are adopted and the children are adopted by only one of the parents and when they separate for whatever reason, obviously the way the courts often decide on third party visitation rights when it comes to children.
The issue for me is that if you follow the law, it is about what is in the best interest of the child. Let's say for example you have a heterosexual couple and the husband is out there having an affair and he's living a promiscuous lifestyle while the wife is doing the same. How is that any different than actually being in a gay relationship? Maybe what might happen is not what we call the traditional family but who gets to define what a traditional family is? Furthermore who are black people to define what a traditional family is? We've all been raised by grandmothers and aunties and the lady down the street. We are often village children. Statistics show that most children in black families are born to single mothers. You have to think outside the box. I hope that my colleagues are thinking outside the box. Regardless if the child comes from parents who are heterosexual or homosexual [placement] should always be in the best interest of the child.

One thing that seems to always bother me with this discussion, is the assumption that gays and lesbians are somehow sterile and don't have our own children. (ie "if the child comes from parents who are heterosexual or homosexual *[placement]*).
I have two biological daughters with a lesbian couple that are lovely well-adjusted teens. (we didn't have sex or use any special technology to conceive). Due to the lack of family rights for gay couples, my parents can't know who their grandchildren are until they are at least 18.

To restrain another human rights is not the American way. Two people of the same sex getting married. 1 question. How would they effect me. Will they take money out of my pocket? Will they burn down the neighbor hood. Will the roof on my church collisp. The point is our country is being a "BIGGETT". The greatest nation in the world is opressing human lives. The one thing that is so! (appalling) to me is that the very people that study the word of God to meet the needs of His people. Will, after wards take that very so! called anointing/power and, turn against the very God they are suppose to be glorifying with His anointing. Judge Penny, you should be ashame of yourself to speak of us! African Americans (even though you are one) have thee nerve to so called! oppress/deny any body else of anything they one to do as adults)I wish that you would stop giving such opinions as Afican Americans centered when you know for yourself as everybody else do, The instructions that in the law, came from God! okay! not the African American society. We are just the part of the society/body of Christ that willing to have the back bone to stand up and, represent our God, that is what we were left here to right? represent Him to the rest of the world right! for this topic inwhich you're talking on, you aren't representing Him or, what he stands for. Donna!.....if we would just get our heads out of our ...flesh and, get ...BACK! into His word, maybe just maybe! we can get to where he wants us to be, You gave a question to is it or, they taking money out of your pockets??? ...where do you think...SOME!!! of these deseases come from( the media won't put that in the news) and, another thing....we as a nations have such shallow minds. Will the building fall down? will and earth quake accurr? well to answer both questions and, all others. I'm a Christian, black, straight, male married for 28yrs. Gay marriage or civil union does not affect my marriage in any way whatsoever. Nor does it affect how my wife and I define our marriage. Legal recognition of someone else marriage does not change the legal rights my wife and I enjoy. Nor does it alter our arc toward our God’s Kingdom.
Apparently, those in opposition of gay marriage for the most part, do so for religious reasons spelled out in the Bible.
Okay, fine.
The Bible also frequently speaks of compliance to God's laws by way of FREE WILL. Deuteronomy 30:19 states “I have set before you life and death, blessing and cursing: therefore choose life.” Again, Joshua 24:15 states “Choose you this day whom ye will serve.... But as for me and my house, we will serve the LORD.” It is apparent to me God wants his children to CHOOSE the right path.
There are many of God's laws that are consistent with man's laws. Violation of these laws can have an adverse affect on society as a whole or in part. This makes compliance with these laws compulsory and exempt from free will.
Gay marriage would have no adverse affect on society as a whole or in part. It may make some people uncomfortable, but no practical harm is done to others.
Compliance with God's laws as a component to enter his kingdom must be that of CHOICE or FREE WILL.

People be careful of your comments and how things affect you especially gays and lesbians. Lesbian with children chill stop depicting something wrong in everything that is not like you; you will become like those that don’t like you? Regardless of how you have your children you have them be happy. STOP fighting over everything and any little thing or persons that do not feel your hearts desire. Save sometime for things that matter and big fish worth fishing for. I think the Judge was honest and pleasant and better than many judgmental idiotic pastors/judges out in the world. Gay marriage will happen and it will be okay and it should be compared to other marriages and the only reason why the church is against it; is because they know it will out last the current marriages in the church!!!! All the in the closet people who are robbers, money hungry pips taking our parents money every week for their glory and blaming it on God; wife beaters, cheaters, drunks, liars, pastors with huge issues, users, adulterers, drug addicts; rapist, thieves, back bitters in the church that smile in your face but can not wait to hurt you. The ones that keep you from getting to God cause they are standing in the doors of the church hypocritical evil people who don’t do God justice will not stop what God has in order. What happen to the Church when the pastor had a JOB; now they say a man of God should not work but be taken care of. Every man of God in the Church should; who is paying me??? Look at the big issue everyone has close their eyes to…the church is being robbed and God has been silent and he will not be fore long….focus on that!!!!

I am tired of people who are calling themselves Ordained baptist minister and not speaking in the word. the problem we have today is a lot of people are going through the ministry and get the degree and say i am ordained this and that. BUT WAS SHE CALLED BY GOD TO PURSUE THIS DEGREE. I THINK WHEN SHE OPENED HER MOUTH AND MADE THIS STATEMENT SHE CLEARLY DEMONSTRATED THAT. I THINK SHE REALLY NEEDS TO GO BACK AND READ THE WORD BECAUSE SHE IS GOING TO BE HELD ACCOUNTABLE FOR ALL THOSE THAT ARE UNDER HER LEADERSHIPSHIP. I AM APPAULD THAT SHE WOULD EVEN EQUATE LESBIAN AND HOMOSEXUALITY WITH RACE. WITH ALL THAT EDUCATION YOU ARE GOING TO EQUATE RACE WITH A PEVERTED SEXUAL ACT. There should be a new law, (besides writing of a will)because some people won't write a will, but a new law for same sex partners. You should name it The new law for same sex partners listed with lose and gain of property, children, etc. Their life is more like a girlfriend, loves/sleep with girlfriend and boyfriend loves/sleep with boyfriend. It's not exactly the relationship that brings children into the world from a marriage. So give them their legal proceedings in a different matter. I'm guessing if that law came through, they wouldn't get married. They should keep shacking up, and quit disappointing the Pontiff and every other peoples who read the Bible. Gay's want to change the Bible soooo bad, when all they have to do is find a law that fit them, and don't tamper with God's words. They will come out better if they find their own way. People come up with new laws all the time, just don't change it to accomendate lust.
